Terms of Service

1. Who we are
Burse ("Burse", "we", "us") provides an online payroll platform for South African businesses at burse.co.za, covering payroll processing, payslips, leave management, statutory calculations (PAYE, UIF, SDL, ETI) and related reporting ("the Service"). By creating an account or using the Service, you agree to these Terms on behalf of yourself and, if applicable, the company you represent ("Customer").
2. The Service
Burse calculates statutory deductions using SARS tax tables in force for the applicable tax year. While we aim to keep these tables accurate and current, Customer remains responsible for verifying payroll outputs, timely SARS submissions (EMP201/EMP501/IRP5), and compliance with the Basic Conditions of Employment Act, Income Tax Act, Unemployment Insurance Act, and Skills Development Levies Act. Burse is a calculation and record-keeping tool, not a registered tax practitioner or payroll bureau acting on Customer's behalf unless separately agreed in writing.
3. Customer responsibilities
- Provide accurate employee, salary and banking information.
- Review and approve each payroll run before payment or submission.
- Keep login credentials confidential and promptly revoke access for departed staff or accountants.
- Use the bank payment file export only for its intended purpose and verify it before upload to your bank.
4. Accounts and access levels
A company account is created by its owner. Owners may invite accountants with read-only access to payroll data, payslips, and reports. Accountants cannot approve payroll runs, edit banking details, or change employee salaries. Owners are responsible for who they invite and for revoking access when no longer required.
5. Fees
Pricing, where applicable, will be disclosed before you are charged. [Placeholder — to be completed once Burse's pricing and billing terms are finalised.]
6. Data and security
Our handling of personal information is described in our Privacy Policy. Customer remains the responsible party for the personal information of its employees under the Protection of Personal Information Act, 2013 (POPIA); Burse acts as an operator processing that data on Customer's instructions.
7. Availability and limitation of liability
The Service is provided "as is" without warranties of uninterrupted availability. To the maximum extent permitted by law, Burse's liability for any claim arising from use of the Service is limited to the fees paid by Customer for the Service in the three months preceding the claim. Burse is not liable for penalties, interest, or losses arising from inaccurate information supplied by Customer or from Customer's failure to review a payroll run before approval.
8. Termination
Either party may terminate an account at any time. On termination, Customer may request an export of its payroll data for a reasonable period before deletion, subject to any statutory retention requirements (South African employers must generally retain payroll records for at least five years).
9. Governing law
These Terms are governed by the laws of the Republic of South Africa, and disputes are subject to the jurisdiction of the South African courts.
